Florida law recognizes three separate species of claims for invasion of privacy:

  • Appropriation of name or likeness—This is the unauthorized use of a person’s name or likeness to obtain some benefit. A common example of this is the use of a photograph or a video recording, used without the consent of the person depicted, for the purpose of selling or promoting a product or service.
  • Intrusion upon seclusion—This is the unauthorized physical or electronic intrusion into the private space of another person. A common example of this is the unauthorized photographing, monitoring or recording of a person without his or her consent, in a place where the person is entitled to an expectation of privacy.
  • Public disclosure of private facts—This is the dissemination of truthful private information which a reasonable person would find objectionable. A common example of this is the dissemination of a person’s medical condition or medical records, which also may be a violation of other state or federal law.

Many states recognize a fourth species of invasion of privacy, which involves the use of true facts to portray another person in a false light. Under Florida law, this conduct is not actionable as an invasion of privacy, but it may be actionable as defamation by implication.

For example, the blurring of the lines between advertising and non-advertising in social media implicates the unauthorized use of one’s name or likeness, and the unauthorized access of email and social media accounts implicates the intrusion upon one’s seclusion and the unauthorized disclosure of public facts.
