Florida law recognizes three separate species of claims for invasion of privacy:
- Appropriation of name or likeness—This is the unauthorized use of a person’s name or likeness to obtain some benefit. A common example of this is the use of a photograph or a video recording, used without the consent of the person depicted, for the purpose of selling or promoting a product or service.
- Intrusion upon seclusion—This is the unauthorized physical or electronic intrusion into the private space of another person. A common example of this is the unauthorized photographing, monitoring or recording of a person without his or her consent, in a place where the person is entitled to an expectation of privacy.
- Public disclosure of private facts—This is the dissemination of truthful private information which a reasonable person would find objectionable. A common example of this is the dissemination of a person’s medical condition or medical records, which also may be a violation of other state or federal law.
Many states recognize a fourth species of invasion of privacy, which involves the use of true facts to portray another person in a false light. Under Florida law, this conduct is not actionable as an invasion of privacy, but it may be actionable as defamation by implication.
