Tampa Computer Abuse & Theft Lawyer
Older, Lundy, Alvarez, Koch & Martino has a team of attorneys devoted to addressing computer abuse and data theft.
There are both state and federal laws that prohibit the unauthorized access, use, and manipulation of computers, computer systems, and electronic data. For many years, the civil remedies available to victims of such abuse were limited. More recently, however, in response to the growing problem of data theft and unlawful invasions into computers and computer systems, Florida passed the Computer Abuse and Data Recovery Act (CADRA), F.S. §668.801, which establishes civil violations and monetary recoveries against unauthorized persons who harm or cause damage to business computers or systems that contain business information or data.
A person violates CADRA if they knowingly and with intent to cause harm or loss:
- obtain information from protected computer without authorization and, as a result, cause harm or loss;
- cause the transmission of a program, code or command to a protected computer without authorization and cause harm or loss; or
- traffic in any technological access barrier through which access to a protected computer may be obtained without authorization.
A person or business harmed by this conduct may pursue a lawsuit in which the injured party may be able to: (i) recover actual damages including lost profits, (ii) recover the violator’s profits to the extent they are not included in the computation of actual damages, (iii) obtain injunctive relief to prevent any further violations, (iv) recover the misappropriated information, program and code, and (v) recover attorneys’ fees incurred to redress the violation.
The computer abuse and theft attorneys at Older, Lundy, Alvarez, Koch & Martino represent clients to ensure that the unlawful interference with their computer systems and the theft and unauthorized use of data is dealt with completely, and that potential monetary compensation and legal consequences are brought upon the ones who committed the act. In some cases, our clients are already aware of the violations when they retain us; in other cases, our clients suspect a violation, and we work with outside forensic consultants to determine whether the clients’ systems or data has been compromised and to identify the source.
