  • Construction Defects. Construction-defect litigation involves a homeowner or project owner’s claim that the project or some part thereof was defectively designed or constructed. We represent homeowners and project owners in the investigation and pursuit of such claims, and we represent general contractors and trade contractors against whom claim are being made. There are various requirements concerning pre-litigation notice of such claims, which trigger the parties’ rights to inspection and discovery. Our attorneys advise, counsel, and pursue the rights of our clients, both before and after the filing of litigation.
  • Insurance Coverage. General contractors, trade contractors, project managers and owners’ representatives typically carry liability insurance, which may provide for indemnification against any liability incurred for a design or construction defect, and may provide the insured with a legal defense or money to pay for its defense. In some cases, the insurance company disputes its obligation to provide coverage to its insured. We represent general contractors, trade contractors, and construction managers in insurance-coverage disputes with their insurance companies.
  • Payment and Contract Disputes. The rights and obligations of general contractors and trade contractors are usually governed by written contracts. These written contracts govern all aspects of the parties’ relationship, such as the amount and timing of payments for work performed, the progress of completed work and the timing of such progress, and the parties’ respective rights regarding indemnification and additional insureds. We represent homeowners, project owners, general contractors, trade contractors, owners’ representatives and construction managers in all types of payment and contract disputes.
  • Mechanic’s liens and bond claims. In order to protect their rights to payment for work performed, contractors and tradespersons may be able to file mechanic’s liens and/or to make claims against a construction bond. The law provides for specific notice requirements as a prerequisite to asserting a lien or asserting a claim against a construction bond. We represent homeowners, project owners, general contractors, trade contractors, owners’ representatives and construction managers in all types of disputes concerning the creation and enforcement of mechanic’s liens and bond claims.
