Let us help you make the best decisions during an emotionally challenging time, and trust us to represent your interests to the fullest.

We make sure our clients’ interests are represented in every court order regarding parenting & timesharing, child support, property division and alimony. We go the extra mile for our clients to ensure they are treated fairly in any divorce or custody proceeding, including using our own in-house CPA to conduct forensic accountings as needed in divorce, alimony and child support matters.

Our comprehensive family law practice encompasses more than just divorce and associated matters. We help couples entering marriage by negotiating, drafting and reviewing prenuptial agreements. Additionally, our lawyers handle family law cases in a variety of legal settings, including collaborative law, mediation, trials and appeals.

Personal Injury

If you’re injured because of the negligence of another, it makes sense that the responsible party should be held accountable to you for the harm they have caused. Justice demands it. Unfortunately, the insurance companies responsible to pay your damages don’t make it easy. They contradict the evidence of your injury and dispute the facts of the accident, and they try to reduce or eliminate their payout by claiming that your own negligence is to blame.

Our experienced personal injury lawyers know how to build and present a strong case for the full amount of your loss, including your medical expenses, lost income, pain and suffering, and other legal damages. We aren’t intimidated by insurance company defense tactics, and if we can’t get you a fair and just settlement, we aren’t afraid to take your case to trial, which is exactly where the insurance companies don’t want to be. Call Older Lundy & Alvarez after a Tampa auto accident, motorcycle accident, slip and fall, defective product injury, workplace accident or other personal injury.

Business Litigation

Business disputes are inevitable. There are simply too many business interactions and transactions occurring in the life of your business to expect that no dispute will ever arise. When disputes do arise, you want experienced business litigators to sit down with you and discuss a strategy that considers risk management, loss mitigation, budgetary concerns, and your overall goals. Older Lundy & Alvarez business lawyers work toward efficient and effective resolution at the earliest stages to resolve breach of contract disputes, business torts, corporate disputes and other business litigation matters.

Estate and Probate

It’s never too early to start estate planning, but if you wait too long, you can find the courts making decisions for you that you wouldn’t make yourself, whether it be imposing a guardianship over your health care or financial affairs, or deciding how to distribute your property to your family members. We take the time to sit down with you and create the estate plan that you want, including a will, trusts, powers of attorney and advance directives that let you decide what happens to you and your estate. Our Florida probate lawyers also handle complicated estate administration matters, helping executors and administrators with the difficult tasks of giving effect to wills and trusts under Florida law in a timely and accurate manner.

Corporate and Tax

Our corporate lawyers are responsive to your needs and are here to serve you for the life of your business, from entity formation to mergers, sales, and orderly business succession or dissolution. No matter your size, Older Lundy & Alvarez is your outside general counsel, providing advice and technical assistance on day-to-day matters as well as the most significant transactions, investments or litigation. We provide comprehensive support, negotiating, drafting and reviewing contracts and policies that keep you in compliance and meet your Tampa business needs and goals.

Our comprehensive tax law practice includes negotiating and preparing installment agreements or offers in compromise to resolve a notice of deficiency. We are at your side during any IRS audit or investigation, providing knowledgeable advice and interfacing on your behalf with federal agents as needed. We work to release tax liens and levies and provide representation in tax litigation at the state or federal level. Whether dealing with payroll tax withholding issues, self-employment tax or other complicated matters, our knowledgeable and experienced tax attorneys are here for you with sound advice and effective assistance.

Real Estate

You invest too much time, money and effort in locating that perfect piece of property or lining up that perfect buyer to watch your deal fall apart due to some technical error or misstep along the way. The Tampa real estate lawyers at Older Lundy & Alvarez can help you with residential or commercial purchase, sale or lease, from title searches and surveys and negotiating the terms of a transaction, to drawing up documents and representing you at closing. Education

University of Southern California, 1993 J.D. Univ. of Miami School of Law, 1999

Benjamin Older is a founding partner of Older, Lundy & Alvarez.

In addition to an active case docket and litigation calendar, he also heads the firm’s community outreach and professional liaison efforts. While Benjamin has a passion for all his cases, he has a particular passion advocating cases which involve issues of drugs and alcohol abuse and specifically how those issues affect children.

Since 2003, Benjamin has practiced exclusively in the area of Marital and Family Law. His practice has always been largely the litigation of Marital and Family Law cases, however his experience dictates that litigation is not always necessary. This experience and belief has translated into a portion of his practice now being dedicated to the cutting edge area of Collaborative Divorce. Benjamin is known for his ability to help clients attempt first to reach a private and amicable solution to their family law matters, before their case escalates into costly and emotionally damaging litigation. Even still, he recognizes that some cases require all of the resources, experience, and tenacity that he and the firm offer in a full blown litigation and attacks those cases head on. Benjamin’s approach to the delicate issues that arise in Marital and Family Law is to remain empathetic and understanding toward each individual client, and to never lose sight of his oath to zealously represent his clients’ best interests. Marital & Family Law

Education

B.A. Yale University, 1996 J.D. University of Miami School of Law, 1999

Michael has been practicing law since 1999, when he began his career in the area of complex civil litigation.

In 2001, he was hired by Alston & Bird LLP, where he worked in both the Atlanta and New York offices in the areas of public and private securities transactions, mergers and acquisitions and general corporate law. In 2003, Michael founded Older, Lundy & Alvarez with Ben Older and the firm has seen extraordinary growth ever since. Currently, Michael practices in the areas of Marital and Family Law and Personal Injury Law.

Michael’s clients find that he demonstrates a great balance of aggressive representation and common sense, and that he is family-oriented, personable and almost always available to provide sound advice and counsel, even after regular business hours and on the weekends. Several of the firm’s clients have commented on his availability, work ethic and compassion, which perhaps is why so many of the firm’s clients refer their friends and family members to him. He has a strong belief that most cases, especially those concerning children, are best resolved by families, instead of by courts. He also believes that every case is unique and requires a delicate balance between understanding the client’s personal needs and life circumstances on the one hand and exercising keen litigation judgment on the other. While he endeavors to find an amicable resolution to every case, when those situations arise that require court intervention, Michael also is a fierce trial lawyer. Learn More
